CartiVerse – Terms of Use & Privacy Policy

CartiVerse Technologies (Pty) Ltd (“CartiVerse”, “we”, “us”, “our”) operates CartiVerse.com (the “Platform”). These Terms of Use, Privacy Policy, and Coin Policy (collectively, the “Agreement”) govern your access to and use of the Platform. By accessing or using the Platform, you accept this Agreement in full.
1. Terms of Service
This section outlines your rights and responsibilities when using the CartiVerse Platform. Violation of these terms may result in immediate suspension or termination of your account.
1.1. Acceptance & Updates
- Your registration, or continued use of the Platform, constitutes your acceptance of this Agreement, including any future amendments.
- We reserve the right to modify or replace these Terms at any time.
- We will provide reasonable notice of any material changes (e.g. via email or prominent notice on the Platform).
- Continued use after such changes means you accept them.
1.2. User Accounts & Security
- Eligibility : You must be at least 18 years old to register. By registering, you confirm that all information you provide is accurate, complete and up-to-date.
- Account Security : You are responsible for safeguarding your password and account credentials. You bear all risks of unauthorised use of your account. CartiVerse is not liable for losses arising from your failure to secure your account.
- Termination : We may suspend or terminate your account at any time, without prior notice, if you breach this Agreement (e.g. but not limited to illegal postings, fraud, abuse).
1.3. Prohibited Conduct and Content
You agree not to use the Platform to:
- Post, sell, exchange, or facilitate transactions involving illegal items, including but not limited to firearms, illicit drugs, stolen goods.
- Misrepresent the condition, price, availability or description of any item, service or listing.
- Distribute spam, malware, viruses, or other harmful code.
- Harass, stalk, defame or infringe upon the rights of other users.
- Violate third-party intellectual property or privacy rights.
- Use automated tools (bots, scrapers) to access or scrape the Platform without prior written permission from CartiVerse.
CartiVerse may remove or block any listing, content or user account that violates these rules.
1.4. User Content & Intellectual Property
- You retain ownership of any content you post to the Platform (photos, text, etc.).
- By posting content, you grant CartiVerse a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, reproduce, adapt, publish, display, distribute and promote that content in connection with the Platform and its services.
- CartiVerse does not claim ownership over your content, this license only allows us to operate the Platform and promote listings.
2. Privacy Policy
Your privacy and the protection of your Personal Data are important to us. We aim to handle your data transparently, securely, and in compliance with applicable Namibian constitutional protections and emerging data protection norms.
2.1. Data Collection & Use
We collect and process the following data:
- Account Data : name, email address, mobile number, town/country (location), hashed password (or equivalent credentials), as provided by you during registration.
- Transactional Data : information related to your use of CartiVerse Coins (purchases, transactions), listings, rentals, exchanges, and any services booked via the Platform.
- Usage & Technical Data : automatically-collected data when you use the Platform e.g. IP address, browser type, device information, pages visited, session times, activity logs (views, likes, shares), and other analytics or security-related metadata.
- Purposes of processing : to provide and maintain the Platform’s services; manage user accounts; process transactions (including payments via third-party gateways); secure the Platform (fraud prevention, abuse detection); personalise the user experience (e.g. “For You” feed); communicate with users (notifications, support); and comply with legal obligations.
2.2. Legal Basis & Consent
- While Namibia’s Data Protection Bill is not yet in force, the right to privacy (including communications and personal information) is constitutionally protected under Namibian Constitution, Article 13.
- Until such national legislation is enacted, CartiVerse undertakes to follow principles compatible with international best practices (lawfulness, purpose limitation, data minimisation, transparency, security, user rights) in how we collect, process and store data.
You provide your consent to data collection and processing by using the Platform or by providing information (e.g. during registration or transactions). You may withdraw consent at any time, subject to limitations (e.g. where data must be retained to complete ongoing transactions or comply with legal obligations).
2.3. Data Security & Storage
We implement commercially reasonable technical and organisational measures, such as encryption, access controls, secure servers, to protect your data against unauthorised access, disclosure, alteration or destruction.
However, no method of electronic storage or transmission is completely secure; we cannot guarantee absolute security.
Your data is stored on secure servers in jurisdictions that meet modern data-security standards. We may transfer data to third-party service-providers (e.g. payment gateways, hosting providers), subject to appropriate safeguards.
2.4. Cookies & Tracking Technologies
We may use cookies, tracking pixels, web beacons or similar technologies to:
- maintain session/authentication;
- personalise your experience (e.g. “For You” feed);
- perform analytics for usage, performance, and security;
- detect and prevent fraud or abuse.
You can configure your browser to refuse or delete cookies; but if you do, certain features of the Platform may not work properly or at all.
2.5. Third-Party Links & External Services
Our Platform may include links, integrations or usage of external services (e.g. payment gateways, social-media plugins, third-party hosting). We are not responsible for the privacy practices, content or policies of such third parties.
We encourage you to review the privacy policy and terms of any external services before using them.
3. CartiVerse Coin Policy
3.1. Purchasing & Value
- CartiVerse Coins are a virtual currency used only within the Platform (e.g. for listing fees, boosting posts, gifting).
- Coins are purchased with real-world currency via approved payment gateways (e.g. PayPal). All purchases are final and non-refundable.
- CartiVerse may change the price of Coins at any time, price adjustments apply only to purchases after the change.
3.2. Usage & Redemption
- Coins may be used solely for internal Platform services (listing fees, boosts, gifting, etc.).
- Coins cannot be redeemed for real-world currency, exchanged for cash, or used outside the Platform’s official mechanisms.
- Coins may not be sold, traded, gifted or transferred between users, except via the Platform’s own in-built gifting mechanism (if provided).
3.3. Taxes & Fees
- You are responsible for any taxes, duties or government fees applicable to your purchase or use of Coins under relevant laws.
- Upon listing an item, service or rental, a non-refundable fee will be deducted automatically.
4. General Provisions
4.1. Governing Law & Jurisdiction
- This Agreement is governed by and construed under the laws of the Republic of Namibia.
- You agree that any disputes arising from or related to this Agreement shall be resolved in the Magistrates courts in Windhoek, Namibia and/or by binding arbitration, at CartiVerse’s discretion.
4.2. Disclaimers & Limitation of Liability
- The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. CartiVerse makes no warranties of any kind, express or implied regarding the reliability, availability, suitability, or security of the service, content, or any listings.
- CartiVerse (and its directors, employees, agents, affiliates, partners, or licensors) will not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of data, profits, goodwill, or other intangible losses, arising from use of, or inability to use, the Platform.
- CartiVerse is not responsible for the conduct of any user, or any third-party service, listing, transaction, or external link.
4.3. Indemnification
You agree to indemnify, defend and hold harmless CartiVerse and its affiliates (agents, employees, contractors, directors) against any and all claims, liabilities, losses, damages, costs or expenses (including legal fees) arising out of:
- your use or misuse of the Platform;
- your violation of this Agreement;
- your User Content; or
- your breach of any law or third-party right.
4.4. Right to Modify / Suspend Services
CartiVerse may modify, suspend or discontinue (temporarily or permanently) all or part of the Platform, with or without notice, for any reason (including maintenance, upgrades, changes in law, security).
CartiVerse will not be liable to you or any third party for any modification, suspension or discontinuation.
